  • Ownership vs. Possession in Thai Law

    A Legal Perspective on Waste Management and Misappropriation Cases 1. Introduction In Thai criminal law, confusion often arises between ownership (กรรมสิทธิ์)  and possession (การครอบครอง) , particularly in cases involving entrusted property or contractual custody. This distinction becomes crucial when determining whether the offense of theft or misappropriation (Section 352 of the Thai Penal Code)  applies. The prosecutor’s decision in the “Clean Mahanakorn case” rested on the erroneous assumption that waste has no owner —and therefore, the company could not be a victim of misappropriation. However, under Thai law, lawful possession  grants protective rights equivalent to those of ownership in criminal contexts. 2. Legal Definitions Concept Legal Foundation Meaning in Practice Ownership (กรรมสิทธิ์) Civil and Commercial Code, Section 1336 The absolute right to use, enjoy, and dispose of a property. Ownership is a real right  (สิทธิในทรัพย์) that persists until legally transferred. Possession (การครอบครอง) Civil and Commercial Code, Sections 1367–1376 The factual control or custody over a property with intent to treat it as one’s own, or on behalf of another. Possession confers protective rights  under both civil and criminal law. 3. Criminal Protection of Possession Under the Thai Penal Code , both ownership and possession are protected. Section 334 (Theft) and Section 352 (Misappropriation) explicitly recognize the rights of “the owner or possessor ” ( เจ้าของหรือผู้ครอบครอง ). Therefore, even if a company does not “own” the waste, it is still protected as the lawful possessor  under its municipal contract. This principle prevents employees or agents from exploiting property entrusted to them during their employment. 4. Supreme Court Precedents 📚 Supreme Court Decision No. 2373/2542 A transport company employee sold goods entrusted for delivery.The Court ruled this was misappropriation (Section 352)  even though the company was not the owner  of the goods — it had lawful possession . 🔹 Application:  Clean Mahanakorn, like the transport company, lawfully possessed municipal waste under a service contract.The drivers’ act of selling recyclables constituted misappropriation of property under the company’s lawful possession . 📚 Supreme Court Decision No. 682/2529 A contractor who took materials belonging to a client and sold them was guilty of misappropriation , as the property was entrusted to him under contract.The Court emphasized that lawful custody = criminally protected possession . 🔹 Application:  The waste recyclables, once loaded onto the company’s trucks, fall under its entrusted custody . Any sale by staff for personal gain directly violates the Penal Code. 📚 Supreme Court Decision No. 3176/2543 A garbage collection employee who sold collected waste was convicted of misappropriation.The Court reasoned that “although waste is abandoned by its owner, once a collector has lawful possession, it becomes his entrusted property until disposal.” 🔹 Application:  This precedent is almost identical to the Clean Mahanakorn case, refuting the prosecutor’s claim that “waste has no owner.” 5. Conclusion The prosecutor’s non-prosecution order reflects a fundamental misinterpretation of “possession” under Thai law .While the Clean Mahanakorn company may not hold ownership ( กรรมสิทธิ์ ) over municipal waste, it holds lawful possession ( การครอบครองโดยชอบด้วยกฎหมาย ) , which the Penal Code explicitly protects. Therefore, any employee or agent selling recyclables for personal benefit commits misappropriation of property entrusted to them —a criminal offense under Section 352 of the Penal Code , as affirmed by Thai Supreme Court precedents.

  • The meeting of O2OESG and Sustainism Initiatives representatives with the executives of Clean Mahanakhon Co., Ltd.

    A delegation from international environmental and sustainability organizations led by Mr. Petch Praphakittikul from AFMA (Agricultural and Food Marketing Association for Asia and the Pacific) and as Director of Sustainism Initiatives (STNSM) , a sustainability policy agency in collaboration with the Food and Agriculture Organization of the United Nations (FAO – UN) together with Mr. Phonphon Chaowirakit from O2OESG Met with Ms. Phurita Angsuwan, CEO of Clean Mahanakorn Co., Ltd., to discuss collaborative approaches to developing a " Sustainability Demonstration Project " that will be presented at the global forum to the United Nations by 2026. 🌱 Purpose of the meeting This discussion aims to: Study the waste management system of Clean Mahanakhon Company Analyze the concept of the " Benefit-Sharing System, " a social innovation that enables all employees in the waste collection process, from drivers, back-row boys, waste sorters, and management, to receive mutual benefits in an equitable and transparent manner.     In a world full of comparison and external evaluation, the concepts of self-esteem and dignity serve as the pillars that enable humans to stand firm and live meaningful lives. While these two terms are closely related, they have distinct meanings, and understanding these differences can help us develop our full potential. Self-esteem: Internal assessment of worth Self-esteem is our overall assessment and attitude towards ourselves. It is a subjective judgment about whether we are capable, valuable, and lovable. Self-esteem is therefore a matter of our feelings and thoughts about ourselves, which can fluctuate depending on circumstances, success, failure, or acceptance from others. High self-esteem: This means that we have a good feeling about ourselves, accept ourselves for who we are, have confidence in our abilities, and are able to face obstacles or disappointments with courage. Low self-esteem: This is when we have a negative view of ourselves, feeling incompetent, unworthy of good things or love, which can lead to emotional problems and inappropriate behavior. Self-esteem is therefore a crucial component for mental health and effective living. It is the driving force that encourages us to set goals and develop ourselves. However, if self-esteem is too closely tied to success or external acceptance, it can make us vulnerable and easily shaken. Dignity: A fundamental value that cannot be taken away. Dignity (human dignity) according to the universal concept is the inherent worth that is in every human being simply because they were born as humans. It is a level of worth that is not dependent on ability, performance, social status or evaluation from others. The Oxford Dictionary defines Dignity as "a degree of worth, respect, and trustworthiness in a person." Respect for human dignity means behaving and acting in accordance with the fundamental principle that all human beings are important and deserve equal respect. Dignity is about rights and dignity that cannot be bought or destroyed. Even in the most difficult circumstances, or when a person suffers a serious setback, human dignity is preserved. This is the foundation of human rights and the treatment of each other in society. Creating a fulfilling life requires developing both: building higher self-esteem through meaningful actions and small accomplishments; and, most importantly, deepening awareness of the dignity of oneself and others. This allows us to live with dignity, self-respect, and genuine respect for the humanity of others—the foundation for a more equitable and compassionate society.
